Kesslers Giveaway
NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN THE PRIZE GIVEAWAY; PURCHASES WILL NOT INCREASE CHANCES OF WINNING THE PRIZE. Giveaway is only open to legal residents of the United States who are at least eighteen years old at the time of entry. Employees of Kesslers Diamond Center, Inc. (“Kesslers”) and their IRS dependents, immediate families (i.e. parents, children, siblings, spouse) and members of their households (whether related or not) are ineligible to participate in this Giveaway.
To enter, go to Kesslersdiamonds.com and complete the Giveaway entry form (available online only) starting on Saturday, July 8th, 2023 from 12:00AM through Saturday, September 30th, 2023 11:59PM. Entrants will be required to provide their name, telephone, email address and mailing address, which will be used for notification and tax reporting purposes only. One entry per person. Multiple entries may be disqualified. Incomplete, inappropriate, unintelligible or otherwise non-compliant entries will be disqualified.
One winning entrant (“Winner”) will be randomly selected from all qualified entries on Friday, October 6th, 2023 by Kesslers, whose decision regarding the Winner will be final. Notification will be provided to the Winner via telephone and/or email within two days of Kesslers selection of the Winner.
The Winner will receive a 1 carat total weight Flickering Firelight Princess Cut diamond (“Prize”) valued at $3846 selected by Kesslers. The Winner will be required to visit one of Kesslers locations within thirty (30) days after being notified of winning to claim the Prize. The Winner will be required to complete an IRS W9 form, and an affidavit confirming acceptance of all conditions of this Giveaway, at the time Winner claims the Prize. Odds of winning the Prize depend on the total number of entries received. Winning entries and the Prize are not transferable. No substitutions of the Prize are allowed except by Kesslers, which reserves the right to substitute the Prize with a prize of equal or greater value. The Prize cannot be redeemed for cash.
The Winner's entry and acceptance of the Prize constitutes the Winner’s permission for Kesslers to use the Winner's name and photograph in all forms of media, including Kesslers’ social media pages and in-store advertising, in perpetuity, without further compensation.
This Giveaway is subject to all applicable federal, state, and local laws and regulations. Non-compliance with any of the foregoing and any other condition of this Giveaway may result in disqualification of the Winner and forfeiture of the Prize. By participating, entrants agree to be bound by these Official Rules and the determinations of Kesslers, which shall be final. Kesslers is not responsible for late, lost or misdirected entries. Kesslers reserves the right, in its sole discretion, to disqualify and/or void entries. This Giveaway and these Official Rules shall be governed and enforced pursuant to Wisconsin law, excluding choice of law provisions. All federal, state or other tax liabilities (including income taxes) arising from this Giveaway will be the sole responsibility of the Winner and Kesslers will issue a Form 1099-MISC to the Winner indicating the value of the Prize. The Winner of the Prize should consult with a tax advisor or professional regarding the consequences of winning the Prize. KESSLER’S does not make any representation OR warranty with respect to the Prize, and hereby disclaims ANY AND all EXPRESS AND IMPLIED warranties, including warranties of merchantability and fitness for a particular purpose with respect to the prize.
